These Terms of Use govern your use of this website and the services available through it. By using the site, you agree to these terms. If you do not agree, do not use the site.

About us and the site

Coldwell Banker Properties is an independently owned Coldwell Banker franchise brokerage and property manager. The site provides information about homes for rent and sale. It also lets visitors save homes in their browser, ask questions, request tours, submit rental applications, request an owner rental analysis and apply for contractor roles.

There is no public sign-up. Applicant accounts are created when an application is submitted. Tenant and owner accounts are available only to eligible users through the separate platform at app.[DOMAIN]. Additional terms may apply to a lease, brokerage relationship, property-management agreement or platform account. If those terms conflict with these site terms, the more specific agreement controls for that service.

Acceptable use

You may use the site for lawful personal or business purposes connected with finding, offering or managing a home, applying for housing, or applying for a contractor role. You must give accurate information and keep account credentials confidential.

You may not:

• break a law or infringe another person's rights;
• submit false, misleading, altered or unauthorized information or documents;
• impersonate another person or access another person's account;
• scrape, crawl, harvest, copy or systematically extract listings, images, contact details or other site content without our written permission;
• post, copy or promote a fake listing, or use our content to make a listing appear to be ours;
• interfere with the site, bypass security, probe for vulnerabilities or introduce harmful code;
• use automated tools to overload forms or send spam;
• reverse engineer site software except where law clearly permits it; or
• use the site or its content to discriminate unlawfully.

We may restrict or block access when we reasonably believe these terms have been violated or the site, a person or a property is at risk.

Listings and availability

We work to keep listing information accurate and current. Information may come from owners, public records, listing services and other sources. Prices, deposits, fees, features, dimensions, schools, taxes, availability and other details can change. Photos, floor plans, maps, videos and three-dimensional tours may not show every condition or feature. You should verify information that matters to your decision.

A listing is not an offer or a promise that a home is available. A question, tour request, application, approval or deposit request does not by itself reserve a home. Availability is not guaranteed until all required parties have signed a lease and any conditions stated in that lease have been met.

Rental applications

Applying is free. Each applicant must provide complete and accurate information and the requested documents. We evaluate applications under written rental criteria and applicable law. The criteria may address identity, income, rental history, credit information, occupancy and other lawful factors.

We may verify information, contact references and, with any consent required by law, use a screening provider. We may approve, decline or approve an application with lawful conditions under the written criteria. We may ask for more information when an application is incomplete or requires clarification. No application outcome creates a tenancy until a lease is signed.

Saved homes

Saved homes are stored only in your browser through local storage. Clearing browser data, changing browsers or changing devices may remove them. We do not promise that saved homes will remain available or listed.

Intellectual property and brand marks

The site design, text, graphics, photographs, videos, software and other content are owned by us, our licensors, property owners or other content providers. They are protected by copyright, trademark and other laws. You may view and print a reasonable amount for your own housing search or other permitted use. No other right is granted.

The Coldwell Banker name, logo and related marks are used under license. You may not use them, or any confusingly similar mark, without permission from the applicable owner. Each office is independently owned and operated.

Third-party services, links and tour embeds

The site may link to or display services operated by others, including maps, three-dimensional tours, videos and account services. Their terms and privacy practices apply to their services. We do not control those services and are not responsible for their content, availability, security or practices. A link or embed does not mean we endorse every statement or service offered there.

Disclaimers

To the fullest extent allowed by law, the site and its content are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will always be available, secure or error-free, or that every listing detail is complete or current.

Nothing on the site is legal, tax, financial, inspection or other professional advice. Rights that cannot lawfully be waived remain in effect.

Limitation of liability

To the fullest extent allowed by law, Coldwell Banker Properties and its owners, officers, employees, contractors and licensors will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, or for lost profits, data, use or opportunity, arising from the site.

To the fullest extent allowed by law, our total liability for a claim arising from the site will not exceed the greater of the amount you paid us to use the site during the 12 months before the claim or $100. This limit does not apply where applicable law forbids it or to liability that cannot lawfully be limited.

Governing law

These terms are governed by the laws of [GOVERNING STATE], without regard to conflict-of-law rules. Any mandatory rights or venue rules that apply where a property or consumer is located remain in effect.

Changes to these terms
